By creating an account or using our Services, you confirm that you:

2. Description of Services

Publiflow provides a social media automation platform that enables users to:

• Create and manage social media content
• Generate AI-powered content using advanced language models (including GPT-4)
• Schedule and publish posts to multiple social media platforms simultaneously
• Connect and manage accounts on platforms including LinkedIn, Facebook, Twitter/X, Instagram, YouTube, TikTok, Pinterest, Medium, Threads, and Reddit
• Access analytics and performance metrics for published content
• Collaborate with team members on content creation

3. Account Registration

To use our Services, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

4. Subscription and Payment

4.1 Free Trial

New users may be eligible for a free trial period. During the trial, you have full access to our Services. A valid payment method may be required to start the trial, but you will not be charged until the trial period ends.

6. Content Ownership

• Your Content: You retain ownership of all content you create using our Services
• License to Publish: You grant us a limited license to publish your content to connected social media platforms on your behalf
• AI-Generated Content: Content generated by our AI features is provided for your use, subject to these Terms and applicable AI model usage policies
• Responsibility: You are solely responsible for ensuring your content complies with all applicable laws and platform policies

7. Intellectual Property

Our Services contain intellectual property owned by Publiflow, including:

• Our website, design, and user interface
• Our proprietary software and algorithms
• Our trademarks, logos, and brand elements
• Our documentation and educational materials

You may not copy, modify, distribute, or create derivative works based on our intellectual property without prior written consent.

8. Third-Party Services

Our Services may integrate with third-party platforms (social media networks, AI providers, payment processors). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

9. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Services will be uninterrupted, secure, or error-free
• Results obtained from using the Services will be accurate or reliable
• The quality of any content will meet your expectations
• Errors in the Services will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUBLIFLOW SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from content published through our Services
• Actions of connected third-party platforms
• Unauthorized access to your account

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Publiflow, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of our Services
• Your violation of these Terms
• Your violation of any law or rights of third parties
• Your content that you publish through our Services

12. Refund Policy

We offer refunds under the following circumstances:

• Technical Issues: If our Services are unavailable for more than 24 consecutive hours, you may request a prorated refund
• First-time Subscribers: First-time subscribers may request a full refund within 7 days of their first payment
• Annual Subscriptions: Annual subscribers may request a prorated refund within 30 days of payment

To request a refund, contact support@publiflow.vip with your account details and reason for the request.

13. Account Termination

You may terminate your account at any time through your account settings or by contacting support. Upon termination:

• Your subscription will end immediately
• You will retain access to your data for 30 days
• Published content will remain on connected platforms
• We will delete your data in accordance with our Privacy Policy

We may suspend or terminate accounts that violate these Terms, with or without notice.

14. Modifications to Services

We reserve the right to modify, suspend, or discontinue any part of our Services at any time, with or without notice. We may also update these Terms from time to time. Material changes will be communicated via email or prominent notice on our website.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved through:

1. Negotiation: Good faith efforts to resolve disputes informally
2. Mediation: Binding mediation in a neutral forum
3. Arbitration: Binding arbitration under the rules of the American Arbitration Association
4. Litigation: Courts of competent jurisdiction in the United States

You agree to waive any class action or collective proceedings.

17. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and AI Transparency Policy, constitute the entire agreement between you and Publiflow regarding your use of our Services.
